These Terms and Conditions apply when you access our website to use osCommerce4you services. Before proceeding to use our services, you should read the Terms and Conditions carefully. If you find yourself unable to agree to them, then you must not use our website. If, however, you agree to them unconditionally you will be given the opportunity to click the "I accept" checkbox during the process of ordering our services, and you will then be able to use our website to which these Terms and Conditions apply.
osCommerce4you may amend these Terms and Conditions at any time by posting the amended Terms and Conditions on our web site and announcing such changes.
Except as stated below, all amended Terms and Conditions shall be automatically effective after they are posted on the site.
All content, graphics, design, and other materials related to
osCommerce4you are protected under applicable copyrights. The copying,
redistribution, use or publication of any such matters or any part of
osCommerce4you is strictly prohibited except by special agreement between
osCommerce4you and you.
osCommerce4you has the right to set an extra price quote if the
client wishes to make additional project changes which were not stipulated before
and were not stated in the project description.
osCommerce4you has a right to cancel the order and refund in the
following cases:
- The client does not give osCommerce4you all the data necessary for customization.
- The client demands unreasonable revision of the order.
- Payment provider suspects the payment to be fraud.
osCommerce4you does not guarantee to complete customization to schedule
specified in preliminary term of completion. Breaks in production may happen because
of customer's activity (i.e. the client doesn't give osCommerce4you all the
data necessary for customization or gives false contacts).
As soon as the customer accepts the result the project is considered to be completed and isn't to be reviewed or revised.
Copyrights
You retain the intellectual rights to all hypertext markup language (HTML), computer
programming, and graphical layout design performed within your web site.
osCommerce4you will give you all info to use and replicate the HTML coding for your own lawful purposes. Rights to source
code, work-up files, and computer programs will be transferred to you, and will remain your property.
However we can use your website in our portfolio and can give the link to your website.
Nondisclosure
osCommerce4you agrees that, except as directed by you, we will not at any time during or after the project disclose any Confidential Information to any person
whatsoever. Likewise, you should agree that you will not convey any Confidential information obtained about the osCommerce4you to another party.
Performance Liability
osCommerce4you does warrant that the functions supplied by Web pages, consultation, advice, or
Internet Website will meet your requirements or that the operation of Web pages will be uninterrupted or error-free.
The entire risk as to the quality and performance of the Web pages and Website is with you. In no event will osCommerce4you
be liable to you or any third party for any damages, including any lost profits, lost savings or other incidental,
consequential or special damages arising out of the operation of or inability to operate these Web pages or Website,
even if osCommerce4you has been advised of the possibility of such damages.
Lawful Purpose
You may only use our services for lawful purpose. Transmission of any material
in violation of any International, Federal, State or Local regulation is prohibited. This includes, but is not limited to
copyrighted material, material legally judged to be threatening or obscene, pornographic, profane, or material protected
by trade secrets. This also includes links or any connection to such materials. osCommerce4you can never sell ideas or
developed work regardless of any non-payment for services. If this happens all material must be destroyed and never reused.
